Arbitration is a more informal process than a trial, whereby a neutral third party, the Arbitrator, resolves a conflict. In a mediation process, the Mediator manages the process as the parties work together to create an acceptable solution. In Arbitration, however, the Arbitrator acts as the decision maker. The Arbitrator’s ruling is legally binding and generally not appealable.
Because Arbitration takes place outside of the court system, legal fees can be reduced and lengthy timelines avoided. Arbitration, like Mediation, is a confidential process not open to the public.
